Terms of Use
By using the mirPod.com web site, you are agreeing to be bound by the following terms and conditions (“Terms of Use”).
1. Description of service
mirPod provides each Account Holder with access to the mirPod website. The Service also includes desktop software tools. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new features, resources, or content, shall be subject to the TOS. In order to use the Service, you must obtain access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access. In addition, you must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device. You also understand and agree that the Service may include advertisements and that these advertisements may be necessary for mirPod to provide the Service. You also understand and agree that the service may include certain communications from mirPod, such as service announcements and administrative messages, and that these communications are considered part of the Service and you will not be able to opt out of receiving them. Unless explicitly stated otherwise, any new features that augment or enhance the current Service shall be subject to the TOS. You agree not to access the Service by any means other than through the interfaces that are provided or explicitly approved by mirPod for use in accessing the Service.
2. Registration
Account Holder will choose a user name and password during the Service’s registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to immediately notify mirPod of any unauthorized use of your password or account or any other breach of security. mirPod cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 2. In consideration of use of the Service, you agree to:
2.1. provide true, accurate, current and complete information about yourself as prompted by the Service’s registration form, and
2.2. maintain and promptly update the Registration Data to keep it true, accurate, current and complete.
If you provide any information that is untrue, inaccurate, not current or incomplete, or mirPod has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, mirPod has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).
You agree that you alone may use the Service with your account, and that sharing your account information and access with anyone else is prohibited.
You are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the Service.
3. Links
The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because mirPod has no control over such sites and resources, you acknowledge and agree that mirPod is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that mirPod shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.
4. Resale of service
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express permission by mirPod.
Basic Terms
You must be 13 years or older to use this site.
You must not abuse, harass, threaten, impersonate or intimidate other mirPod users.
You may not use the mirPod.com service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.
You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links (“Content”) that you submit, post, and display on themirPod.com service.
You must not modify, adapt or hack mirPod.com or modify another website so as to falsely imply that it is associated with mirPod.com.
You must not create or submit unwanted email to any mirPod members (“Spam”).
You must not transmit any worms or viruses or any code of a destructive nature.
You must not, in the use of mirPod, violate any laws in your jurisdiction (including but not limited to copyright laws).Violation of any of these agreements will result in the termination of your mirPod.com account. While mirPod.com prohibits such conduct and content on its site, you understand and agree that mirPod cannot be responsible for the Content posted on its web site and you nonetheless may be exposed to such materials and that you use the mirPod.com service at your own risk.
General Conditions
We reserve the right to modify or terminate the mirPod.com service for any reason, without notice at any time.
We reserve the right to alter these Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, we will notify you via internet mail according to the preference expressed on your account. What constitutes a "material change" will be determined at our sole discretion, in good faith and using common sense and reasonable judgement.
We reserve the right to refuse service to anyone for any reason at any time.
We may, but have no obligation to, remove Content and accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Use.
The mirPod service makes it possible to post images audio video with players hosted on mirPod to outside websites. This use is accepted (and even encouraged!). However, pages on other websites which display video audio and images with the players hosted on mirPod.com must provide a link back to mirPod from each channel or show to its channel or show page on mirPod.
Copyright (What’s Yours is Yours)
We claim no intellectual property rights over the material you provide to the mirPod service. Your profile and materials uploaded remain yours. You can remove your profile at any time by deleting your account. This will also remove any audio and images you have stored in the system.
We encourage users to contribute their creations to the public domain or consider progressive licensing terms. Accordingly, we will offer the ability to mark your content as belonging to the public domain or as licensed under a Creative Commons license.
mirPod undertakes to obey all relevant copyright laws. We will review all claims of copyright infringement received and remove content deemed to have been posted or distributed in violation of any such laws. To make a claim, please provide us with the following:
A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
A description of the copyrighted work claimed to have been infringed;
A description of the infringing material and information reasonably sufficient to permit mirPod to locate the material;
Your contact information, including your address, telephone number, and email;
A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.Claims can be sent by mail.
